1. Acceptance of These Terms

Clear expectations for using our website and requesting estate-planning education and coordination.

These Terms of Service govern your use of the Fortis Planning website and your participation in educational events, consultations, and estate-planning education or coordination services offered by Fortis Planning, LLC.

2. Description of Services

Fortis provides general education and coordination related to estate-planning topics. Depending on the service requested, this may include educational conversations about trust-based and will-based plans, powers of attorney, special needs trusts, and related planning concepts; educational events; consultations; and coordination of next steps.

The scope, availability, and fees for a particular service will be described before you make a purchase or enter a separate service agreement. Services may vary by location, provider availability, and the type of support requested.

Fortis is not a law firm and does not provide legal advice or prepare legal documents. Services provided by an attorney or another independent professional are subject to that professional’s separate terms and responsibilities.

3. Eligibility and Authority to Request Services

You must be at least 18 years old to enter into a service agreement with Fortis. A person under 18 may participate in an educational event or consultation only with appropriate involvement from a parent or legal guardian.

You agree to provide accurate information when contacting Fortis or requesting a service. If you submit information on behalf of another person, you are responsible for having the authority to do so and for making sure the person knows about the request.

4. Nature and Limitations of Notary Services

Fortis provides general education and coordination. Information shared through this website, an event, or an educational conversation is not legal, tax, accounting, investment, or individualized financial advice. It is not a recommendation that a specific plan, document, account, or strategy is right for you.

Fortis does not draft, revise, or select legal documents. Questions about the legal effect, suitability, or requirements of a document should be directed to a licensed attorney in the appropriate jurisdiction. Questions about tax, accounting, investment, or financial matters should be directed to a qualified professional in that field.

Contacting Fortis does not create an attorney-client relationship. If you engage an attorney or another independent professional, that relationship is governed by your separate agreement with that professional.

5. Inquiries, Consultations, and Events

Submitting a form, email, text, or scheduling request does not by itself create a confirmed consultation, event registration, or service agreement. A request is confirmed only after Fortis communicates acceptance and any applicable time, scope, and fee.

You are responsible for reviewing confirmations and promptly correcting inaccurate information. Event details, availability, and delivery format may change. Fortis will make reasonable efforts to communicate material changes using the contact information provided.

6. Your Responsibilities

You agree to use the website and services lawfully and respectfully. You are responsible for the decisions you make and for seeking professional advice appropriate to your circumstances.

Please do not submit Social Security numbers, complete financial-account numbers, medical records, passwords, or copies of legal documents through a general website form or ordinary email unless Fortis has specifically requested the information through an approved method.

7. Fees and Payment

Any fees, payment timing, and included services will be disclosed before you purchase a service or enter a separate agreement. You authorize Fortis and its payment provider to process the amount you approve. A third-party provider may process payment information under its own terms and privacy practices.

8. Cancellations, Rescheduling, and Refunds

Cancellation, rescheduling, and refund terms for a paid service will be disclosed in the applicable service description, confirmation, invoice, or written agreement. If no separate term applies, contact Fortis promptly to discuss a change or cancellation. Any refund will be handled under the terms disclosed for that service and applicable law.

9. . Communications and Text Messages

If you provide a mobile number and affirmatively opt in, Fortis may send service-related text messages about your inquiry, requested consultation, event, or service. Marketing messages will be sent only when you separately consent.

Message frequency varies. Message and data rates may apply. Consent to receive marketing text messages is not a condition of purchasing a service. Reply STOP to opt out or HELP for assistance. Mobile information and text-message opt-in consent will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes. Service providers may process this information only to support communications on Fortis’s behalf.

10. Website Content and Intellectual Property

The website and its original text, graphics, logos, photographs, page layouts, educational materials, and other content are owned by Fortis or used with permission and are protected by applicable law.

You may view the website for personal or legitimate business purposes. Without written permission, you may not copy or republish substantial portions of the website, sell or license its content, remove ownership notices, use Fortis branding to imply an affiliation, or use the content for misleading or unlawful purposes.

11. Third-Party Services and Links

The website or a Fortis service may link to or use third-party websites and tools, including scheduling, payment, video-meeting, email, messaging, and educational platforms. These providers operate independently and may have their own terms, privacy policies, security practices, and availability. Review their terms before using them or submitting information.

12. Prohibited Uses

You may not use the website or services to violate the law or another person’s rights, submit false or misleading information, impersonate another person, interfere with website security, introduce harmful code, or disrupt the website or services. Fortis may restrict access or decline a request when reasonably necessary to protect users, the business, or the public.

13. Disclaimers

The website and general educational content are provided for informational purposes and may not reflect the latest law or apply to your circumstances. Fortis does not guarantee a particular result, legal outcome, tax treatment, eligibility determination, or financial outcome.

The website and services are provided as available, subject to any warranties that cannot lawfully be excluded. Nothing in these Terms limits a right or remedy that cannot be limited under applicable law.

14. Limitation of Liability

To the fullest extent permitted by law, Fortis will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from your use of the website or a service, including interruptions, third-party platform issues, or reliance on general educational information.

To the fullest extent permitted by law, Fortis’s total liability arising from a particular paid service will not exceed the amount you paid directly to Fortis for that service. This section does not limit liability that cannot lawfully be limited.

15. Indemnification

To the fullest extent permitted by law, you agree to be responsible for claims and costs arising from your unlawful use of the website or services, your material breach of these Terms, or information you submit without authorization. This provision does not apply where prohibited by law.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules, except where applicable law requires otherwise. Before filing a claim, the parties are encouraged to make a good-faith effort to resolve the issue through written communication.

17. Changes to These Terms

Fortis may update these Terms to reflect changes in services, technology, business practices, or legal requirements. The updated version will be posted on this page with a revised “Last updated” date. Changes apply prospectively unless applicable law or a separate agreement provides otherwise.

If a provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law. These Terms and any applicable written service agreement govern your use of the website and the service requested.
